Kuwait to Implement Strict Licensing Rules for Influencer and Celebrity Advertisements

Kuwait is preparing to implement strict regulations for celebrity and social media influencer advertisements through a new Media Law currently in its final stages at the Legal Advice and Legislation Department. Reliable sources have revealed that the ministry will require influencers and celebrities to obtain advertising licenses from both the Ministry of Information and the Ministry of Commerce and Industry to combat fraudulent advertising practices on social media platforms.

The new legislation contains two specific chapters addressing advertising mechanisms and licensing requirements for content creators. The Ministry of Information will verify social media accounts of influencers, celebrities, and advertising companies, ensuring all advertised products and services are properly licensed. For example, advertised medicines must have Ministry of Health approval, while real estate exhibitions require Commerce Ministry licensing before promotion.

Sources have confirmed that violators will face legal action through the Public Prosecution, with the regulations covering visual, printed, and written advertisements. The identification of influential accounts will be based on reach and audience impact measurements. Implementation procedures will include electronic verification requests to the Ministry of Information, account registration with personal information, and signed declarations committing to regulatory compliance.

The ministries are coordinating to establish a regularization period for compliance before enforcing penalties. This initiative follows numerous court cases resulting from misleading celebrity endorsements that defrauded consumers, prompting the government to establish clear accountability frameworks without favoritism.
